Custody entails deciding who will be responsible for what for the children after the divorce. The court holds authority in the ultimate legal decision, but if the child is over 14 years of age then he/she can choose how to resolve custody between the parents. For a father, certain obstacles can be in the way to gaining custody.

Circumstances as well as personal wishes both play a role in custody. If the parents are not married, the father might have to present a proof of paternity before requesting custody. Also, if the other party requests custody, then generally courts are more favorable to ordering joint custody unless there is domestic violence in the home. The child’s wishes may also be considered by the court before assigning custody to the father.

Fathers could also be at a slight disadvantage because of a previous societal decision that mothers were better parents and should get custody preferably. This ideal stems from the tender years doctrine, which states that mothers should get custody because a young child needs the love and care a mother can best provide. However, recently the court has adopted a more gender-neutral approach so that ultimately decisions are made based on what’s best for the child.
