Georgia handles property division with an equitable distribution method, which means both spouses are entitled to an equitable share of all property gained during the marriage. However, an equitable share does not necessarily mean an equal share. Community property laws require an equal share, but equitable distribution methods do not.

Property must first be divided between separate and marital property. Marital property includes any property gained by either spouse during the marriage, and separate property includes any property gained by either spouse before the marriage. Once that is settled, divorce courts hold the greatest power in determining the actual property division because there are no regulations they must adhere to. However, the couple has the option to work out their own property division agreement in writing so they don’t have to go to court.

Because men tend to play a larger role in financial responsibilities for the family, they may see themselves entitled to a greater portion of property. Reversely, women are typically more inclined to be more focused on relationships and interpersonal goals than men, so they are less likely to be aggressive towards obtaining monetary benefits. However, property division can become easily complicated to figure out, so attorneys are helpful to employ regardless of whether the case will go to court or not.
